Enclosed please find a Mediation Notice we received from the Eleventh Circuit Court of Appeals- It schedules mediation in the appeal for Monday October 30, 2000 at 2:00 pin at Room 1304 of the Claude Pepper Federal Building, 51 Southwest First Avenue, Miami. This is t191 where the trial took place but is just off Flagler Avenue. It should not take more that three hours for mediation. The mediation process is an attempt to help the parties resolve the issue in dispute without it going any further. 1 will be forwarding a copy of our brief to the mediator for his review.
We can meet at that the Federal Building Room 1304 at 1:30 pm so that we have time to review the issues which may be discussed.

If you have a directly conflicting court appearance and need to reschedule this date, you should consult with opposing counsel and then call the Miami administrative assistant, Judy Richardson. at 305-536-3005, to suggest other dates when all participants are available.
The purpose of the mediation is to explore possibilities for settlement of the dispute. The enclosed document provides information about the mediation process and mediation representation. You are identified on the Civil Appeal Statement form as the attorneys with primary responsibility for this appeal. You should have your clients present or available by phone during the mediation and have authority to respond to settlement proposals that are consistent with your client's intorcst3. If you have a brief due before the mediation date and would like to request an extension, please read Eleventh Circuit Rule 33-1(e) and the enclosed document. If you file a brief before the mediation date, please mail me a copy. I recommend you send me a "Confidential Mediation Statement" assessing the appeal. I will not share your statement with the other side. and it will not become part of the court file.
